Terms and conditions

These terms govern the use of the hoopyup.com site and of the HoopyUp app by creators. By using the app you accept them. Relationships with brands are governed by a separate commercial agreement.

Last updated: 3 October 2026

1. Who we are

HoopyUp is a service of Hoopygang S.r.l., Via del Tiratoio 1, 50124 Florence, Italy, VAT IT06747140488, REA FI 652961 ("Hoopygang", "we"). For any communication write to info@hoopyup.com: it is also our point of contact for authorities and users under the EU Digital Services Act (DSA).

2. How it works

  • Hoopygang publishes in the app the campaign briefs of brands and advertisers.
  • You pick a brief and accept it. You receive a personal tracked link, tied to you and to that brief.
  • You create the content following the brief and submit it in the app. Our staff reviews it and approves it, or rejects it and tells you why.
  • You publish the approved content on your social profiles with your tracked link.
  • When a user takes the action set in the brief (for example a lead or a contract) and the advertiser or network validates it, you earn the compensation.

3. Account

  • To use the app you must be at least 18 and able to enter into a contract.
  • Each person may have one account only. The data you give us, including tax details, must be true and up to date.
  • You are responsible for access to your account and for what happens with it. If you think someone else is using it, write to us at once.
  • You can also sign in with a Google, Facebook, Instagram or TikTok account. In that case that service's terms apply as well.

4. Compensation

  • Compensation is performance-based only: you earn an amount for each validated action, at the rate shown in the brief when you accept it. There is no fee for publishing alone.
  • A recorded action stays "pending" until the advertiser or network validates it. Rejected actions earn nothing. Validation follows the advertiser's rules, which we do not control.
  • Once an action is validated the amount becomes "available" in the wallet. Above the minimum threshold shown in the app you can request a payout.
  • We pay by SEPA transfer, PayPal or Stripe. Compensation is subject to the tax rules of your regime (for example withholding tax, or an invoice under a VAT number): you are responsible for your own tax and social security obligations.
  • If an already validated action is cancelled by the advertiser for fraud or error, or turns out to have been generated in breach of these terms, we may reverse the related amount with an offsetting wallet entry.

5. What you may not do

  • Generate fake clicks or conversions: with bots, automated software, incentives not provided by the brief, or purchases or sign-ups made by you or on your behalf to earn the compensation.
  • Publish content other than the approved one, or change it after approval so that it no longer meets the brief.
  • Omit the disclosure that the content is advertising, or use wording other than the one the brief requires.
  • Publish content that is unlawful, misleading, offensive, or that infringes third-party rights or the rules of the social network you publish on.
  • Hand your tracked link or your account over to others.

6. Advertising disclosure

Content you publish for a brief is commercial communication. You must make that evident with the wording set in the brief (for example "Advertising" or "ADV"), clearly and immediately, in the text and, for videos and stories, as an overlay, in line with the law and the social network's rules. The social network's partnership label alone may not be enough.

7. Your content

Your content stays yours. By submitting it you grant us a non-exclusive, royalty-free licence to store it, review it and show it to the campaign's brand, in order to run the brief, verify publication and results and document compensation. Any further use by the brand, for example in its own campaigns, is stated in the brief before you accept it.

You warrant that you hold the rights to what you publish, including music, images and the people who appear in the content.

8. Content review and suspension

  • We review every piece of content before publication. We reject it if it does not meet the brief, these terms or the law, and we always tell you why.
  • If you breach these terms we may suspend or close your account and cancel the compensation generated by the breach. We tell you the reason and you can reply by writing to info@hoopyup.com: we review the decision.
  • If you see content or a brief in the app that you believe is unlawful, you can report it to the same address, saying what it is and why. We reply with the outcome.

9. Relationship between the parties

You use HoopyUp independently: you choose whether and which briefs to accept, how and when to create content, and you have no availability or volume obligations. These terms create no employment, agency or partnership relationship between you and Hoopygang.

10. Third-party services and liability

Social networks, advertisers, affiliate networks and payment providers are third-party services: we are not responsible for their rules, outages or decisions, including the validation of actions.

We do our best to keep the app running without interruption, but we cannot guarantee it. To the extent permitted by law, we are not liable for indirect damage or for damage not caused by our wilful misconduct or gross negligence.

11. Closing your account

You can close your account whenever you want, as explained on the Data deletion page. Available amounts above the minimum threshold are paid to you; pending amounts are paid to you if validated within 90 days of closure. The processing of your data is described in the privacy policy.

12. Changes

We may update these terms. We notify you in the app at least 15 days before a material change takes effect; if you do not accept it you can close your account. Briefs already accepted remain governed by the terms in force when you accepted them.

13. Governing law and jurisdiction

These terms are governed by Italian law. The courts of Florence have jurisdiction over any dispute, without prejudice to the mandatory jurisdiction the law grants to consumers.
